FYProof respects the rights of copyright owners and expects its users to do the same. We respond to notices of claimed copyright infringement that follow the Digital Millennium Copyright Act (17 U.S.C. § 512), and we close the accounts of repeat infringers.
Videos uploaded to FYProof are private: only the person who uploaded them, the people they share a team with (if teams are offered), and our administrators (for safety and support) can see them. They are deleted 72 hours after the check. We never publish them.
1. Sending us a notice
If you believe material on FYProof infringes your copyright, send a written notice by email to dmca@fyproof.com, or use our report form and choose copyright. The notice must include:
- Your physical or electronic signature, as the copyright owner or someone authorized to act for them (typing your full name is enough).
- A description of the copyrighted work you say is infringed.
- A description of the material you say is infringing, and enough information for us to find it (for example the account email or report link).
- Your name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
A notice that is missing any of these may not be acted on. When we receive a complete notice, we remove or disable access to the material and tell the user who uploaded it, with instructions for sending a counter-notice. We don't give that user your contact details unless the law requires it.
2. Counter-notices
If your material was removed and you believe it was a mistake or misidentification, you can send a counter-notice by email to dmca@fyproof.com that includes:
- Your physical or electronic signature.
- A description of the material removed and where it was before it was removed (you can quote the reference in our email).
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the US, any judicial district where FYProof may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We send a copy of the counter-notice (including your name, address and phone number) to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we may restore the material 10 to 14 business days after we received the counter-notice.
3. Repeat infringers
We close, in appropriate circumstances, the accounts of users who repeatedly infringe copyright. An account that is the subject of three valid notices within 12 months (that were not successfully countered) will be closed. A notice that is successfully countered no longer counts.
Knowingly misrepresenting that material is infringing, or that it was removed by mistake, can make you liable for damages, including costs and attorneys' fees (17 U.S.C. § 512(f)).
